Terms of Use

These terms of use (the “Agreement”) are applicable to the: (i) web pages, (ii) services, (iii) content, (iv) chatbot/virtual assistance, (v) databases, and (vi) information (collectively referred to as the “Services”) together with the agreements and software provided by UE Capital Ltd (“UEC”) to which you may have access by using UEC’s website or, upon request, in hard copy. The content and information included in these Services are provided by UEC and its third-party suppliers (collectively, the “Information Providers”). These Services are available by UEC subject to the terms and conditions stated below.

By using the Services, you confirm your consent to be bound by the terms of this Agreement. If you disagree, the Broker cannot provide you with access to the Services, and you should immediately discontinue your use of the Services. You agree that the Broker may modify this Agreement at any time at its sole discretion and without prior notice. Such changes will be posted online and will be effective upon posting. You should review this Agreement periodically to ensure familiarity with its then-current terms and conditions. Your continued use of the Services shall constitute your acceptance of this Agreement, and your continued use of the Services following any modification of this Agreement shall constitute your acceptance of the Agreement, as amended. If you disagree with the changes, you must notify the Broker in writing or by telephone of your refusal and discontinue your use of the Services.

These Services are intended for your personal, non-commercial use.
By using the above-mentioned Services and the software provided by the Broker, you acknowledge and agree that:

  • It is prohibited to use, store, reproduce, display, modify, sell, publish, transmit, distribute, or commercially exploit the Services without prior written permission of UEC, UE Capital, Broker, and/or any Information Provider(s);
  • UEC, UE Capital, Broker, and/or any Information Provider(s) reserve all rights to proprietary information (including, but not limited to, all intellectual property rights such as; patents, trademarks, service marks, copyrights, database rights, topography rights, industrial design, know-how, trade secrets, trade names, logos, designs, symbols, emblems, insignia, slogans, drawings, plans and other identifying materials, in all forms whether or not registered or capable of registration and any other rights relating to intellectual property in accordance with the applicable laws,) subsisting in or relating to the Services.
  • You shall not use the Services for any unlawful or unauthorized purpose, including (but not limited to) submitting any material to the Broker through the Services that may be considered (by the Broker) to be abusive, defamatory, threatening, or otherwise harmful to others; or by uploading or transmitting viruses or any other type of malicious code that will or may be used in a way that will affect the functionality or operation of the Services.
  • The use and interpretation of the Services require skill and judgment, and you shall at all times exercise your own judgment in the use of the Services.
  • You are responsible for all statements made and acts or omissions that occur while your user identification name (or “User Name”) and passwords are being used. You are responsible for protecting and securing your User Name and password from unauthorized use and disclosure. If you become aware of, or believe there has been, any breach of security for any of your information stored on the Broker’s website, such as the theft or unauthorized use of your User Name, password, or any other information, you will notify the Broker immediately.
  • The Services and the Software have been prepared for informational purposes only without regard to any particular user’s investment objectives, financial situation, or means, and UEC is not soliciting any action based upon it. Any material provided by the Services is not to be construed as financial, tax, legal or other advice; a recommendation; or an offer to buy or sell; or the solicitation of an offer to buy or sell any security, financial product, or instrument; or to participate in any particular trading strategy in any jurisdiction in which such an offer or solicitation, or trading strategy would be illegal. 
  • The fact that the Broker has made the Services available to you constitutes neither a recommendation to enter into a particular transaction nor a representation that any product described on the website is suitable or appropriate for you. Many of the products described in the Services involve significant risks, and you should not enter into any transactions unless you have fully understood all such risks and have independently determined that such transactions are appropriate for you. You acknowledge that certain transactions, including those involving complex financial instruments, give rise to substantial risk and are not suitable for all investors. Any discussion of the risks contained herein with respect to any product should not be considered to be a comprehensive disclosure of all risks or a complete discussion of the risks which are mentioned. You should not construe any of the material contained herein as business, financial, investment, hedging, trading, legal, regulatory, tax, or accounting advice.

The Client accepts the Broker’s right to notify the Client that his account can enter a Margin Call at 100%. The margin call calculation is the following

  • The Client acknowledges that if the Client’s margin level reaches equal or less than 20%, the Broker has the right to close the Client’s open positions at its own discretion, meaning Stop Out.

  • In the event of Slippage occurring during trading activities, the Broker shall not be held liable to refund the Client. Slippage, defined as the difference between the expected price of a trade and the price at which the trade is executed, may occur due to various market conditions, including volatility and liquidity. The Client acknowledges and accepts that slippage is a normal occurrence in trading and agrees that the Broker shall not be responsible for any financial losses incurred as a result.
  • The Broker reserves the right to restrict the number of transactions performed by the Client through the Platform and cancel some or all of them due to actions performed by the Client that are considered by the Broker at its own discretion as abusive trading strategies or due to regulatory reasons. The Broker should send a motivated notice shortly (within one business day) after conducting the stated in using valid communication channels.
  • The Client acknowledges that it is its sole responsibility to check its Platform settings, including but not limited to settings of a Trading Platform, Instruments, Mark-ups, Commissions, Leverage, Margin Call, and Stop Level, before starting to trade with Financial Instruments, placing orders, and conducting transactions.
  • In cases where the Client chooses to use trading algorithms, including expert advisors, or trailing stops, the Broker shall not be held responsible for any losses which may be incurred pursuant to their use. However, should the Broker become aware that the Client utilizes the relevant trading algorithms in bad faith or contrary to the terms contained herein, the Broker reserves the right to take necessary actions.
  • The Client acknowledges and agrees that the Broker reserves the right, at its sole discretion (but not the obligation), to liquidate all or part of the Client‘s positions or assets in any of the Client‘s accounts at any time without prior notice if the Client engages in market abuses or uses abusive trading strategies.
  • High-Frequency Trading (HFT) is considered toxic. The Broker reserves the right to oblige the Client to stop using such trading strategies.
  • The Broker shall not permit/accept abusive trading strategies, whether by using sophisticated technology or manual methods when such trading is based on error(s), or any other method(s) found to be abusive but not pre-defined.
  • The Broker may take one or more of the following countermeasures if the Client is found to be using mentioned or not pre-defined abusive trading strategies or toxic flow:
    • Adjust the price(s) provided to the Client.
    • Change the price spreads offered to the Client.
    • Change the trading conditions/limitations applied to the Client’s account(s).
    • Cancel the transaction(s).
  • The Broker does not provide advising services, including but not limited to financial, legal, tax, regulatory, investment, or other advice and/or recommendation.
  • The Broker is not required to perform appropriate and/or suitability tests for the Client to ensure whether the Services offered by the Broker are suitable for the Client. The Client hereby confirms that they have the necessary knowledge and experience and, as such, make an informed decision about the Services offered by the Broker.
  • The Client is considered Professional and deemed to have the requisite knowledge and experience to independently assess and decide on the suitability and risks of the Transaction(s).
  • The Client is solely responsible for trading in Financial Instruments offered by the Broker, based on their personal assessment. The Client is encouraged to seek independent advice if they deem it necessary.

the Broker may exercise full discretion in modifying or discontinuing any part or whole of the Services specified under points (i) to (vi) subject to this Agreement at any time without cause or prior notice.

The Broker and the Information Provider(s) expressly disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.

Although the Services provided have been obtained from sources deemed to be reliable, the Services are provided “as is,” and the Broker and/or any Information Provider(s) provide the Services without responsibility for accuracy, correctness, and availability. By using the Services, you agree that errors and/or omissions contained in the Services shall not be made the basis for any claim, demand, or cause of action against the Broker or any Information Provider(s).

Neither the Broker nor any of its Information Providers shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to this Agreement or resulting from the use or the inability to use the Services, including but not limited to damages for loss of profits, use, data or other intangible damages, even if such party has been advised of the possibility of such damages.

By agreeing to this Agreement and the software, you acknowledge and agree that the Broker, in the interest of security, reserves the right to record all telephone conversations, internet conversations, including chat, and any meetings between you and the Broker. Your interactions with the Broker via the Services may be used for further development of the Broker’s algorithms and artificial intelligence models. Any personal information you provide through the use of the Services is governed by the Broker’s Privacy Policy. You agree that the Broker reserves the right to monitor your use of the Services on the website and that the Broker may use the resultant information for its internal business purposes.
